A Palatka marine salvage business owner was arrested after being accused of deliberately sinking a large boat in the St. Johns River, Florida Fish and Wildlife Conservation Commission officials said Thursday.

Mark Edward Musselman was arrested Thursday morning after the State Attorney issued a warrant and an FWC investigation was conducted, said FWC Lt. George Pottorf.

According to Pottorf, the owner of a 48-foot powerboat that sank at the Quality Inn Riverfront dock contracted with Musselman to salvage the vessel.

"To salvage it, he and several contractors raised the vessel, did some salvage work, then took it at night and attempted to sink it," Pottorf said.

After interviewing witnesses and conducting an investigation, a felony charge of commercial littering was filed, he said.

Commercial littering is charged when someone dumps without permission for commercial purposes anywhere, including the St. Johns River, he said.

"Charges can be up to five years in prison and a $5,000 fine," he said.

Pottorf said it was his understanding that it cost Musselman more to salvage the vessel than what he and the owner contracted for.


He said Musselman also purchased the boat for $25 from the owner.

"The owner refused to pay more. Because of that, he (Musselman) took it down the river and sunk it," he said.

Pottorf said he originally discovered the sunken boat at the Quality Inn docks about a month ago while investigating a large oil slick.

"The owner of the boat was the manager of the Quality Inn. She hired the individuals to remove the boat," he said. "She was doing the right thing, getting the boat out."

He said about a week ago, he received a call from a commercial fisherman that there was a sunken vessel one mile north of the Memorial Bridge, just south of the power lines near Crystal Cove Marina.

"When we arrived we knew exactly what boat it was," he said.

The Palatka Fire Department responded to help contain and remove diesel fuel leaking from the boat, he said.

"Our main concern right now is that the bow sticks up, creating a navigational hazard," he said.

To warn boaters, the Coast Guard has placed a large green buoy and a lighted buoy near the boat as navigational warnings, he added.
